Jamees and Murjia

Praise be to Allaah on his own, and
blessings and peace be upon the whom, there is no prophet sent after
him.
The Permanent Committee for Research
and Iftaa’ (Giving Islamic Verdicts), had a look at that which had
reached The Grand Mufti from Ibraheem Al-Hamadaani, this referral was
directed to the Committee from the Lajnat Kibar Al-Olamaa’ (The body of
Most Knowledgeable scholars), i.e. The highest Islamic authority in
Saudi Arabia, under the number (942) and date 1/2/1419. The Following
question was asked:
“ Your kindness, the grand Muftee of
Saudi Arabia, Shaikh Abdul-Azeez Ibn Baz May Allaah keep him safe. As-Salaamu
Alaikom Wa Rahmatullaahi Wa Barakaatuh, We, at this blessed country,
Saudi Arabia, live under some great virtues, and one of the greatest of
those is Tawheed, and when it comes to Takfeer we reject both Khawarej
and Murji’ah Math-habs (ways, sects). Lately, during the past few days,
I had a book named, Ihkaam At-Taqreer Fi Ahkaam At-Takfeer, by
Muraad Shukree, a Jordanian, and it had come to my knowledge
that he is not a scholar, and that his formal studying was not of
Islamic nature, however, he, in his book, has been spreading the invalid
Math-hab of the extreme Murji’ah, which is, there is no Kufr except the
Kufr of Tak-theeb (Belying).
And this according to my knowledge is
against the truth, against the Daleel (Proofs) which Ahlus-Sunnah Wal
Jamaa’ah are upon, and it is also against what the leaders of Da’wah in
thisblessed land had taught, that is the people of knowledge had agreed
that Kufr can be reached through saying, action, belief and/or
suspicion. I hope to see clarification of the Haqq (truth) in this
matter, so that no one will be misguided by this book, which The
Salafi-Jama’ah in Jordan are calling for its contents. May Allaah be
your guardian, Was-Salaamu Alaikom Wa Rahmatullaahi WaBarakaatuh.”
After Studdying the Matter, The Lajnah
answered that: After looking at the mentioned book, it was found that it
contains what was said (by Ibraheem Al-Hamadaani), as it establishes and
calls for Murji’ah Math-hab, that is thereis no Kufr except that of
Juhood (rejection) and Tak-theeb (Belying). It also introduces this
cursed Math-hab as if it were the Math-hab of As-Sunnah, and as if the
Olamaa’ of the Salaf had gone that way. All of that is Jahl (ignorance)
of the truth and Talbees (mixing the facts with fantasies) and it is
also Tadh-leel (misguiding) for the brains of the youth, making it look
as if it were the saying of the Salaf of the Ummah and its knowledgeable
scholars.
Yet it is the Math-hab of the Murji-ah,
who claim that no Sin should harm, once Iman is there. And Iman, in
there view, is the belief of the heart, and Kufr is Tak-theeb (belying)
and this is an extreme in looseness. On the opposite, there is the
invalid Math-hab Al-Khawarij, which is an extreme of lightening,
regarding Takfeer. Both of the two Math-habs are invalid and rejected as
ways of misguidance. Allaah has guided the Ahlus-Sunnah Wal-Jamaa’ah to
the correct saying and true way and to the middle belief between the two
extremes, They preserve the ‘Erd of the Muslim and his religion and they
believe that a Muslim should not be made a Kafir except when it is truly
supported by Daleel (evidence), They also believe that Kufr is
established through: saying, actions/leaving actions, belief and/or
suspicion, all the proofs from the Book of Allaah and the Sunnah are
gathered to support that.
Therefore, from what had been
mentioned, it is not permissible to publish or print that book; it is
not permissible also to relate the book’s contents to the proofs from
the Book and the Sunnah, or to relate its contents to the Math-habof
Ahlus-Sunnah Wal-Jamaa’ah. The person who wrote the book and the one who
published it should announce their Tawbah to Allaah, for Tawbah (… two
unclear words), and those who have not established themselves in the
Islamic knowledge, should not get into such subjects so that harm and
misguiding should not occur while hope in benefit and corrections was
the initial aim and intention. And With Allaah guidance obtaind.

for Research and Iftaa’ (Giving Islamic Verdicts), regarding a book
titled (Ruling With Other than What Allaah Had revealed and the roots of
Takfeer) By, Khalid Al-‘Anbari
Praise be Allaah on his own, and
blessings and peace be upon our Prophet, Muhammad, his family and
companions ..

and Iftaa’ (Giving Islamic Verdicts),had a look at a book titled: Al-hokm
Bi ghair Ma Anzala-Allaahu Wa Usool At-Takfeer. (Ruling With Other than
What Allaah Had revealed and the roos of Takfeer), By Khalid Al-‘Anbari.
After studying the Book, it was clear that it contains abuse of the
scientific trust in what the author had transmitted from the statements
of Ahlus-Sunnah Wal-Jamaa’ah scholars and the distortion of the use of
the proofs and pointing them towards other issues for which they cannot
be used as proofs, based on the rules of the Arabic Language and the
aims of the Sharee’ah, here is some examples:
He distorted the meanings of the
Islamic legal proofs, and modifying some of the statements, he
transmitted from the people of knowledge, that includes: omitting and
completely changing the text so that when it is read, the understanding
which will occur will be different to the original. Explaining some of
the sayings of people of knowledge with other than what they meant.
Lying on the people of knowledge, when
he related to the Al-Laamah shaikh Muhammad Ibn Ibraheem, that which he
never said. His false claim of Ijmaa’ (unanimity) of Ahlus-Sunnah in
that the one who does rule with other than what Allaah had revealed,
with regards to general Tashree’ (rulings) is not a kafer, except by
heart-based Istihlaal, just like dealing with other sins which doesnot
rise to the status of Kufr. And this is a pure Iftiraa’ (knowingly
lying) on Ahlus-Sunnah, due to either Jahl (ignorance) or Soo’ul-Qasd
(bad aims), weask Allaah safety and security.
Building upon the above, The Lajnah
sees that it is Haraam to print, publishor sell the mentioned book, The
Lajnah reminds the author with Tawbah to Allaah Ta’aala and seeking the
opinions of the trustworthy people of knowledge, so he can learn from
them and also to show him his mistakes. We ask Allaah guidance for
everyone and success and firm-hood in Islam and strong attachment to
thesunnah May Allaah send his blessings and peace upon our prophet and
his family and his companions….

Praise be to Allaah on his own, and
blessings and peace be upon the one whom, there is no prophet sent after
him.
The Permanent Committee for Research
and Iftaa’ (Giving Islamic Verdicts), had a look at what was referred to
his kindness, the grand Mufti, by some of the sincere advising people,
asking him. Those questions are registered in the General Trust of the
body of Kibar Al-Olamaa’ under the number (2928) dated 13/5/1421 and
number (2929) dated 13/5/1421. The questions are regarding two booklets:
At-Tahtheer Min Fitnat At-Takfeer (The warning From The Fitnah Of
Takfeer) and Saiyhat Natheer (A Shout of a Warner), The collector of the
material of the two booklets is Ali Hasan Al-Halabi. The
question mentions that the two booklets call for the Math-hab of Irjaa’,
that is: Actions are not a fundamental condition upon which the
correctness of Imaan depends, and relating that to Ahlus-Sunnah Wal
Jamaa’ah, It was also mention that the author built those books on
distorted transmissions from Shaiykh al-Islam Ibn Taymiyah and the
Hafeth Ibn Katheer and others, may Allaah be merciful to all of them.
There was a hope, from those advisors, to see clarifications of the
material of the booklets so that the readers of them know the right-hood
from the wrong-hood.
After The Lajnah studied the two books,
it was very clear to the Lajnah that the book titled At-Tahtheer Min
Fitnat At-Takfeer (The warning From The Fitnah Of Takfeer), Collected by
Ali Hasan Al-Halabi, and in that which he added to the
sayings of the Olamaa’ in the introduction and in the commentaries
contains the following: The author built it based on the invalid
innovative Murji’ah Math-hab, who limit the Kufr In Kufr Al-Juhood
(denial Kufere), Kufr At-taktheeb (belying Kufr) and Kufr al-Istihlaal
in the heart (believing thata Haram, is to be made Halal) as it is seen
in P. 6 commentary 2 and also in P. 22. And this opposes that which
Ahlus-Sunnah Wal Jamaa’ah are upon, that is Kufr can be reached through
Believing, saying, action and/or suspicion.
The author’s Tahreef (distortion) in
transmitting from Ibn Katheer, may Allaah bemerciful to him, from
Albidayah Wan-Nihayah 13/118, where he mentioned in his commentary P.15,
relating the saying to Ibn Katheer, “That Jankis Khan claimed that the
Yaseq (his own made book) is from Al that made them Kuffar.” When it was
checked, in the mentioned book, the saying, claimed to be Ibn Katheer’s,
may Allaah have mercy on him, was not found.
Lying on Shaiykhul Islam Ibn Taiymiyah,
May Allaah have mercy on him, P. 17-18 where he, the author, relates to
Ibn Taiymiyah that the Mubaddel-Ruler (the ruler who changes the Islamic
rules) is not considered Kafir in the eyes of Ibn Taiymiyah, unless if
this changes were based on Ma’rifahg knowledge, I’tiqaad (belief) and
Istihlaah (believing that a Haram Is Halal). And this is pure false
claiming on Shaiykhul Islam Ibn Taiymiyah, May Allaah be merciful to
him, for surely he is one whospread the Math-hab As-Salaf, Ahlus-Sunnah
Wal Jamaa’ah, and their way is as was mentioned previously, but this is
the Math-hab f Al-Murji’ah.
His distortion of the meaning meant by
Al-‘Allaamah Shaikh Mohamad Ibn Ibraheem, May Allaah bemerciful to him,
in his Risaalah (small book) Tah-keem Al-Qawaneen Al-Wadh’eiyah (Seeking
The Verdict Of The Man Made Laws), where the author of the mentioned
book falsely claims that the sheikh makes Istihlaal-by the heart a
condition for the Kufr. Yet the words of the shaikh are as clear as the
sun, in his named above Risaalah, which is upon the path of Ahlus-Sunnah
Wal Jamaa’ah. · His commentary on the sayings of the people of knowledge
and implying that their saying means what it does not mean, P. 108,
comm. 1, P. 109 comm. 21 and 110comm.2.
Also the book contains Belittling of
the importance of ruling with that which Allaah had revealed, especially
in P. 5/1. Claiming that paying special attention to enforcing and
explaining Tawheed in this area is considered to imitating the Rafidhah,
and this is a grave mistake. By looking at the second booklet Saiyhat
Natheer, it was found to be a supporting tool to the content of the
first booklet (which is discussed above), Therefore The Lajnah sees that
it is not to be made permissible to print, publish or even handle those
two booklets, and that is because of what they contain of Batil
(false-hood) and Tahreef (distortion).
And we do advice the booklet’s author
to fear Allaah in himself and in the Muslims and especially their youth,
We advice him to work hard in gaining Islamic knowledge from the
‘Olamaa’ trusted and known for the correctness of their ‘Ilm and
‘Aqeedah. He is also advised that knowledge is a trust, and it should
not be spread except after making sure it is according to the Kitaab and
the Sunnah. He should give up such wrong opinions and highly shameful
approaches in distorting the word and pointing them to the wrong
meanings, and it is known that coming back to the Haqq is a blessed act
and a cause of dignity for Muslims.
